MEMBERSHIP AND TERMS OF USE AGREEMENT
Before benefiting from the products and services offered through the address http://www.edition5.store (the “Website”), Member Users must accept this Membership and Terms of Use Agreement. The Terms of Use contained within the Agreement are also valid for other Users and Visitors who do not hold Member status. As long as you visit, use, and benefit from the Website, the provisions of this Agreement shall apply to the extent they correspond to your status.
1. Rules of Use and Security
1.1 The process of creating a member registration is free of charge. Unlike non-member Users, Members are enabled to benefit advantageously from the products and services offered through the Website during certain periods.
1.2 Members, other Users, and Visitors are obliged to comply with the following rules during the time they are on the Website; otherwise, the Website management may prevent these persons from using the address and may initiate legal action against them.
1.2.a It is prohibited to share information on the Site as a comment (content) that contains incorrect, irregular, incomplete, and misleading information, or expressions that do not comply with general rules of morality and conflict with the laws of the Republic of Türkiye.
1.2.b All types of rights over the design, functions, working principle, and visual and written content of the Site belong to the firm EDITION5 DEKORASYON VE GÖRSEL HİZMETLER LİMİTED ŞİRKETİ; these cannot be copied or used, even partially, without permission from these persons.
1.2.c Member Users are responsible for the security of the username and password information they determine while creating a member registration. The relevant Member User is directly responsible for all kinds of damages that may arise due to sharing this information with third parties and organizations or allowing them to use it.
1.2.d Member Users and other Users must not use someone else’s IP address, e-mail address, username, and similar personal data during the product purchasing process. Otherwise, this may constitute “identity theft” and may require legal action to be initiated against you. Persons acting contrary to this provision are deemed to have accepted all kinds of legal and criminal liabilities.
1.2.e It is prohibited to engage in actions that will threaten the security of the Site, prevent the operation of the functions located on the Site, to use software, or to attempt to obtain the information located on the Site and its interface outside the control of the Site management. 2. Responsibilities
2.1 Site Visitors’ information (visit duration, time, viewed pages) is tracked for the purposes of making the Site operation efficient and increasing the product/service quality. Adhering to data protection legislation, this information is shared with the firms with which we cooperate regarding digital advertising and marketing for the purpose of improving Visitor and User experiences.
2.2 The Member User who creates a member registration can start using the Site by filling out the sections required for registration and, after confirming their electronic mail address, entering their electronic mail address and password in accordance with this Agreement.
2.3 While benefiting from the products and services on the Site, the User accepts to comply with the Turkish Penal Code, Turkish Commercial Code, Law on Intellectual and Artistic Works, Statutory Decrees and legal regulations regarding the Protection of Trademark and Patent Rights, provisions of other relevant legislation, and all kinds of notices to be published over the address http://www.edition5.store. All kinds of legal, criminal, and financial liability that may arise due to usage contrary to these notices and legislation belong to the User.
2.4 In the event it is determined that the User does not comply with the obligations specified in this Agreement and the Notices published on the Site, the User’s utilization of the Site may be prevented temporarily or indefinitely and/or the Member User registration may be closed.
2.5 Member Users, other Users, and Visitors cannot engage in actions that prevent or make it difficult for each other to use the Site, and cannot lock servers or databases by uploading automatic programs. They cannot engage in fraud attempts. In the event they do, they accept all kinds of legal and criminal liability that may arise.
2.6 The User cannot delete or remove explanations regarding copyright, trademark, and other intellectual rights over any digital and printed material obtained through the Site.
2.7 Membership cancellation and account deletion process can be done by the Member User through the Site. The Membership Registration of the User who terminates their membership is finalized.
2.8 Different rules and obligations specific to that area may be notified in certain areas of the Site. Persons who benefit from these areas must comply with the relevant Notices as specified in provision 2.3 of this Agreement.
2.9 Personal data of Member Users, other Users, and Visitors are processed in accordance with data protection legislation. In this scope, these persons are required to read the “Privacy Notice” located on the website.
2.10 Member Users and other Users are deemed to have accepted that the payment information (credit card, GSM number information, etc.) they use in purchases they will make through the Site is correct, and that the legal and criminal liability arising from these belongs to them. Member Users give consent to the use of the payment information they save in the member transaction area for subsequent purchases.
3. Notification Addresses
3.1 Site Member Users and other Users accept that the electronic mail address they have declared is the Official correspondence and notification address, and that the written address required for subsequent correspondence can be requested and notified through this channel. Every type of change to be made in the electronic mail address must be notified to the Site management.
3.2 It will be accepted that every type of notification to be made to the registered electronic mail address of the Member User and other User reaches the relevant User 1 (one) day after the electronic mail is sent by EDITION5 DEKORASYON VE GÖRSEL HİZMETLER LİMİTED ŞİRKETİ.
In the event of any inconsistency or discrepancy between the Turkish and English versions of this policy, the Turkish version shall prevail.

ÜYELİK VE KULLANIM ŞARTLARI SÖZLEŞMESİ
http://www.edition5.store adresi (“Web Sitesi”) üzerinden sunulan ürün ve hizmetlerden yararlanmadan önce Üye Kullanıcıların işbu Üyelik ve Kullanım Şartları Sözleşmesini kabul etmeleri gerekmektedir. Sözleşme içerisinde yer alan Kullanım Şartları, Üye statüsünde olmayan diğer Kullanıcı ve Ziyaretçiler için de geçerlidir. Web Sitesini ziyaret ettiğiniz, kullandığınız ve Siteden yararlandığınız sürece statünüze uygun düştüğü ölçüde işbu Sözleşme hükümleri uygulanacaktır.
1. Kullanım ve Güvenlik Kuralları
1.1 Üye kaydı oluşturma işlemi ücretsizdir. Üyeler, üye olmayan Kullanıcılardan farklı olarak Web Sitesi üzerinden sunulan ürün ve hizmetlerden belirli dönemlerde avantajlı olarak yararlandırılırlar.
1.2 Üye, diğer Kullanıcı ve Ziyaretçiler, Web Sitesinde bulundukları süre boyunca aşağıdaki kurallara uymakla yükümlüdürler, aksi takdirde Web Sitesi yönetimi bu kişilerin adresi kullanmalarını engelleyebilir ve kişiler hakkında yasal işlem başlatabilir.
1.2.a Yanlış, düzensiz, eksik ve yanıltıcı bilgiler, genel ahlak kurallarına uygun olmayan ifadeler içeren ve Türkiye Cumhuriyeti yasalarıyla ters düşen bilgilerin Sitede yorum (içerik) olarak paylaşılması yasaktır.
1.2.b Sitenin tasarımı, fonksiyonları, çalışma prensibi, görsel ve yazılı içeriği üzerindeki her tür hak EDITION5 DEKORASYON VE GÖRSEL HİZMETLER LİMİTED ŞİRKETİ firmasına aittir, bu kişilerden izinsiz olarak kısmen de olsa kopyalanamaz ve kullanılamaz.
1.2.c. Üye Kullanıcılar üye kaydı oluştururken belirledikleri kullanıcı adı ve şifre bilgilerinin güvenliğinden sorumludurlar. Bu bilgileri üçüncü kişi ve kuruluşlarla paylaşmaları ve bunlara kullandırmaları nedeniyle oluşabilecek her tür zarardan doğrudan ilgili Üye Kullanıcı sorumludur.
1.2.d Üye Kullanıcılar ve diğer Kullanıcılar, ürün satın alma işlemi esnasında başkasına ait IP adresi, e-posta adresi, kullanıcı adı ve benzeri kişisel verileri kullanmamalıdırlar. Aksi durum “kimlik hırsızlığı” teşkil edebilir ve hakkınızda yasal işlem başlatılması gerekebilir. Bu hükme aykırı hareket eden kişiler her tür hukuki ve cezai yükümlülüğü kabul etmiş sayılır.
1.2.e Sitenin güvenliğini tehdit edecek, Sitede yer alan fonksiyonların çalışmasını engelleyecek işlemlerde bulunması, yazılımların kullanılması, Site ve ara yüzünde yer alan bilgilerin Site yönetiminin kontrolü dışında elde edilmeye çalışılması yasaktır. Bu hükme aykırı hareket eden kişiler her tür hukuki ve cezai yükümlülüğü kabul etmiş sayılır.
2. Sorumluluklar
2.1 Site Ziyaretçilerinin bilgileri (ziyaret süresi, zamanı, görüntülenen sayfalar) Site işleyişini verimli hale getirmek ve ürün/hizmet kalitesini artırmak amacıyla takip edilmektedir. Bu bilgiler, veri koruma mevzuatına bağlı kalınarak, içeriği Ziyaretçi ve Kullanıcı deneyimlerini iyileştirmek amacı ile dijital reklam ve pazarlama konusunda işbirliği yaptığımız firmalarla paylaşılmaktadır.
2.2 Üye kaydı oluşturan Üye Kullanıcı, kayıt için gerekli olan bölümleri doldurup elektronik posta adresini onayladıktan sonra işbu Sözleşmeye uygun şekilde elektronik posta adresini ve şifresini girerek Siteyi kullanmaya başlayabilir.
2.3 Kullanıcı, Sitede bulunan ürün ve hizmetlerden yararlanırken, Türk Ceza Kanunu, Türk Ticaret Kanunu, Fikir ve Sanat Eserleri Kanunu, Marka ve Patent Haklarının Korunması ile ilgili Kanun Hükmünde Kararnameler ve yasal düzenlemeler, diğer ilgili mevzuat hükümleri ile http://www.edition5.store adresi üzerinden yayınlanacak her türlü bildirime uymayı kabul eder. Bu bildirimlere ve mevzuata aykırı kullanım sebebiyle doğabilecek hukuki, cezai ve mali her türlü sorumluluk Kullanıcıya aittir.
2.4 Kullanıcının işbu Sözleşmede belirtilen yükümlülüklere ve Sitede yayınlanan Bildirimlere uymadığının tespiti halinde, Kullanıcının Siteden yararlanması süreli veya süresiz olarak engellenebilir ve/veya Üye Kullanıcı kaydı kapatılabilir.
2.5 Üye Kullanıcı, diğer Kullanıcı ve Ziyaretçiler, birbirlerinin Siteyi kullanmalarını önleyici veya zorlaştırıcı hareketlerde bulunamaz, sunucuları veya veri tabanlarını otomatik programlar yükleyip kilitleyemez. Hile girişimlerinde bulunamaz. Bulunması halinde doğabilecek her türlü hukuki, cezai sorumluluğu kabul eder.
2.6 Kullanıcı, Siteden üzerinden elde edilmiş dijital ve basılı hiçbir materyal üzerinden telif hakkı, ticari marka ve sair fikri haklarla ilgili açıklamaları silemez veya çıkartamaz.
2.7 Üyelik iptali ve hesap silme işlemi, Üye Kullanıcı tarafından Site üzerinden yapılabilir. Üyeliğini sonlandıran Kullanıcının Üyelik Kaydı sonlandırılır.
2.8 Sitenin belirli alanlarında o alana özel farklı kurallar ve yükümlülükler bildirilebilir. Bu alanlardan yararlanan kişiler, işbu Sözleşmenin 2.3 hükmünde belirtildiği şekilde ilgili Bildirimlere uymak zorundadır.
2.9 Üye Kullanıcıların, diğer Kullanıcıların ve Ziyaretçilerin kişisel verileri veri koruma mevzuatına uygun şekilde işlenir. Bu kapsamda bu kişilerin web sitesinde yer alan “Aydınlatma Bildirimini” okumaları gerekmektedir.
2.10. Üye Kullanıcı ve diğer Kullanıcılar Site üzerinden yapacakları alışverişlerde kullandıkları ödeme bilgilerinin (kredi kartı, GSM numarası bilgileri vb.) doğru olduğunu bunlardan kaynaklanan hukuki ve cezai sorumluluğun kendilerine ait olduğunu kabul etmiş sayılırlar. Üye Kullanıcılar, üye işlem alanına kaydettikleri ödeme bilgilerinin sonraki alışverişlerde kullanılmasına onay verirler.
3. Tebligat Adresleri
3.1 Site Üye Kullanıcıları ve diğer Kullanıcılar, bildirdikleri elektronik posta adresinin Resmi yazışma ve bildirim adresi olduğunu, sonraki yazışmalar için gereken yazılı adresin bu kanal üzerinden talep edilebileceğini ve bildirilebileceğini kabul ederler. Elektronik posta adresinde yapılacak her tür değişikliğin Site yönetimine bildirilmesi gerekmektedir.
3.2 Üye Kullanıcı ve diğer Kullanıcının kayıtlı elektronik posta adresine yapılacak her tür bildirimin elektronik postanın EDITION5 DEKORASYON VE GÖRSELHİZMETLER LİMİTED ŞİRKETİ tarafından yollanmasından 1 (bir) gün sonra ilgili Kullanıcıya ulaştığı kabul edilecektir.
İşbu metnin yorumlanmasında Türkçe versiyon esas alınacaktır.
